How to Sell a Mobile Home With Delinquent Property Taxes in Texas

Falling behind on property taxes happens to a lot of mobile home owners. A bill gets missed after a move, a home is inherited with years of taxes already owed, or money was simply tight. The good news is that back taxes rarely make a mobile home impossible to sell in Texas. They do have to be dealt with before ownership can change hands, though, so it pays to understand how the process works.

How Property Taxes Work on a Texas Mobile Home

If your manufactured home is recorded as personal property, which is the case for most homes in parks and many homes on private land, it has its own tax account with the county, separate from the land it sits on. Bills usually go out in the fall and are due by January 31. Starting February 1, unpaid taxes begin picking up penalties and interest, and additional collection costs can be added later in the year.

One detail surprises many owners: in Texas, the person who owns the home on January 1 is generally responsible for that year’s taxes. If you’re new to all of this, our overview of property taxes on a mobile home in Texas covers the basics.

What a Tax Lien Means for Your Sale

When taxes on a manufactured home go unpaid, the taxing authority can record a tax lien against the home with the Texas Department of Housing and Community Affairs (TDHCA), the agency that tracks mobile home ownership. That lien shows up on the home’s record, right alongside the owner’s name and any lender’s lien.

This matters for two reasons:

  • Ownership can’t transfer until recorded tax liens are cleared. TDHCA will not issue a new Statement of Ownership to your buyer while a recorded tax lien is still outstanding.
  • The tax office has to sign off. As part of a transfer, TDHCA generally requires a statement from the county tax assessor-collector confirming the taxes are paid for the 18 months leading up to the sale.

In other words, a buyer can hand you cash and you can hand over the keys, but the sale isn’t truly finished until the tax side is resolved. For a walk-through of the transfer itself, see our guide to the Texas Statement of Ownership.

Step 1: Find Out Exactly What You Owe

Don’t guess. Before you talk to buyers, get the real numbers:

  • Call or visit your county tax office and ask for the full balance on the mobile home’s account, including penalties, interest, and any collection fees. Ask what the total will be next month too, since the amount grows.
  • Look up your home in TDHCA’s online ownership records to see whether any tax liens have been recorded and for which years.
  • If the home is on land you own, check the land’s tax account as well. The home and the land may be billed separately.
  • If the home was inherited or bought from a previous owner without a proper transfer, ask whether older taxes are sitting under someone else’s name.

Step 2: Choose How the Taxes Will Get Paid

You have more options than writing one big check today.

  • Pay the taxes off before you sell. This is the cleanest route if you have the money. Once the tax office is paid, the lien can be released and the sale moves forward like any other.
  • Pay the taxes out of the sale. This is the most common approach. The back taxes are paid from the purchase price at closing, and you receive the rest. An experienced buyer can coordinate the payoff directly with the tax office so nothing falls through the cracks.
  • Ask about a payment plan. Many Texas tax offices will set up installment agreements on delinquent accounts. A plan can stop the situation from getting worse while you get the home ready to sell, but the balance will still need to be settled before ownership transfers.
  • Sell to a buyer who handles the payoff. Cash buyers who work with mobile homes regularly are used to tax liens. They factor the amount owed into the offer and take care of the paperwork with the county and TDHCA.

What If You Owe More Than the Home Is Worth?

It happens, especially with older homes that have several years of unpaid taxes. If the tax balance is close to or higher than what the home would sell for, you still have choices. Start by talking to the tax office about what they can and can’t do, and get an honest opinion of the home’s value. Our post on how to determine the value of your mobile home can help you set expectations.

What you shouldn’t do is ignore it. The balance keeps growing, the taxing authority can eventually take legal action to collect, and if the home is in a park, lot rent keeps coming due the whole time.

Mistakes to Avoid

  • Selling on a handshake. A bill of sale alone doesn’t transfer a mobile home in Texas. If the ownership record never changes, future tax bills can keep landing in your name.
  • Hiding the taxes from a buyer. The lien will show up when the buyer checks the TDHCA record. Being upfront saves everyone time and keeps the deal from falling apart late.
  • Waiting for the new year. If you still own the home on January 1, another full year of taxes is generally yours.
  • Assuming it’s hopeless. Back taxes are one of the most common problems we see, and most of the time there is a workable path to a sale.
